Terms and Conditions

1 Dirndl Rental Agreement

The following Terms of Service (“Terms”) between you (“you” or “your”) and Miss Oktoberfest Dirndl Rental Shop (“we,” “our,” “us,” or “Miss Oktoberfest”) describes the terms and conditions on which you may access and use the shop registered under www.miss-oktoberfest.com. These Terms also apply to on-location rentals and sales, which are part of the Services. By accessing or using any of the Services, you acknowledge that you have read, understood and agreed to be bound by these Terms. Owner rents to Renter and Renter rents from Owner, subject to the terms and conditions of this Agreement.

2 Shop information

The shop registered under www.miss-oktoberfest.com is a private shop run from Shiba 5-1-6 202, Minato-Ku, 108-0014, Tokyo. Further information on the renter can be found in the imprint.

3 Contract

After reservation request, the customer will receive a confirmation email including the payment modalities by e-mail. In case of availability, the dress will be reserved for 3 working days.
After payment of security deposit and rental fee, the rental agreement is considered as recognized by both parties and commences under the listed terms and conditions. It shall remain in full force and effect until the dress is returned to the Owner. The dress will be shipped to arrive on the first day of the reservation. The Renter will be responsible for the postal fees for the return of the dress.
As soon as the dress reaches the Owner, the security deposit will be returned to the Renter.
The Renter agrees to return the dresses on or before the return date for that are identified in the online invoice for the order. If the dress will be returned late, extra charges occur with respect to the days past after the return date for the dress. Postal delivery receipts are used to proof a return in time here.

4 Security Deposit

In addition to the rental fees, the Renter shall pay a deposit at the time this Agreement is signed. The Owner may use the deposit to cover any amounts due under this Agreement. In case of a regular return of the dress, the deposit will be completely returned the the Renter.

5 Property of the rental item

The dress remains property of the Owner during the complete rental period and has to be returned after the rental contract ends. If the dress is not returned, the Owner reserves the right to take any action necessary to regain possession of the dress.

6 Damage and Loss

Dresses can only be used in a careful and proper manner and shall not be used in any way that is inconsistent with Owner’s instructions or manuals. The costs of all repairs made during the term shall be paid by Renter, including but not limited to labor, material, parts and other items. Small damages will be charged a general rate of 1000 Yen,  large damages with a one-week rental fee. Equipment shall not be serviced or repaired and parts and accessories shall not be replaced without Owner’s prior consent. Renter shall alert Owner to any damage to the dress immediately.  Renter shall be responsible for any loss or damage to the dress and loss of use, diminution of the dress’s value caused by damage to it or repair to it and missing equipment.

7 Cleaning

The Products will be professionally cleaned and delivered ready to wear. Miss Oktoberfest dry cleans and inspects each Product with the utmost care, but use of the Product is at your own risk.

8 Cancelation Policy

In case of a failed delivery of the rental item by the Owner, the Renter shall be immediately refunded all feed paid.
The owner is not responsible for any other request by the Renter.
The Renter can cancel the reservation free of charge before postal delivery and will receive full and will receive a full refund issued to the payment card you used for the order or in cash.

9 Sizing Returns

If your Product does not fit you, then you may return the Product within 24 hours of the date you received the Product. Miss Oktoberfest will then issue you a credit for the full Rental Fee (less delivery charges) of the Product for a future rental by you of our Products, so long as the Product, in our sole discretion, has not been worn. Return has to be announced via phone or e-mail in time.

10 Delivery

Ordered items will be send to the address indicated at the time of reservation. Genereally, delivery will be carried out by third parties, Personal delivery can only be made on special request at the time of booking under a special surcharge.

11 Privacy

All customer data is only used and saved for the processing of the reservation. Data will not be passed to others. Furter information can be found in our privacy policy.

12 Agreement

This Agreement represents the entire understanding relating to the subject matter hereof and prevails over any prior or contemporaneous, conflicting or additional communications.
